TESTIMONIAL RELEASE FORM

I agree with and represent to Collect 200 Pty Ltd T/as Broker Smart Office as follows:

(a)         I have reached the legal age to form a binding contract with Collect 200 Pty Ltd T/as Broker Smart Office in my jurisdiction of residence;

(b)         I hereby give Collect 200 Pty Ltd T/as Broker Smart Office (including without limitation its representatives, employees, agents and sub-licensees) my permission, irrevocably, worldwide and in perpetuity, to reproduce, copy, publish, broadcast, communicate to the public by telecommunications, make available and otherwise use:

(i)            my full name, company and trading name, state of business premises, the comments, testimonials and other statements that I have provided via email, online form, and/or posted to Collect 200 Pty Ltd T/as Broker Smart Office’s owned or controlled social media accounts (e.g. Instagram, Facebook, X ) and any other content that I may provide to Collect 200 Pty Ltd T/as Broker Smart Office (in part, as is or as may be edited or in whole) (collectively, my “Content”) to create materials that advertise or promote Collect 200 Pty Ltd T/as Broker Smart Office or any of its products (collectively, with the Content, the “Materials”); and

(ii)           the Materials in any type of media (including without limitation digital media, social media platforms and networks, print media and multimedia presentations);

(c)         I represent and warrant that any comments, testimonials or other statements I have made reflect my true and honest opinions and are based upon my own experiences with Collect 200 Pty Ltd T/as Broker Smart Office or its goods or services regarding Collect 200 Pty Ltd T/as Broker Smart Office or its products and services

(d)         I represent and warrant that, at the time I made such comments, testimonials or other statements, I had not received any type of benefit or inducement for making such comments, testimonials or other statements;

(e)         I acknowledge that I will receive no compensation from Collect 200 Pty Ltd T/as Broker Smart Office other than any goodwill and publicity that I may receive relating to Collect 200 Pty Ltd T/as Broker Smart Office’s use of the Materials;

(f)          I acknowledge that Collect 200 Pty Ltd T/as Broker Smart Office

(i)            will be under no obligation to actually use the Materials and

(ii)           has the right to use the Materials either with or without my name;

(g)         I agree that I shall have no right of approval, no claim to subsequent compensation or benefit arising out of the use of the Materials;

(h)         I, to the extent that I may have any moral rights in the Materials,

(i)           agree to Collect 200 Pty Ltd T/as Broker Smart Office’s use of the Materials in the manner contemplated herein and

(ii)      to the extent possible waive all such moral rights in favour of Collect 200 Pty Ltd T/as Broker Smart Office;

(i)           I agree to release, indemnify, and hold harmless Collect 200 Pty Ltd T/as Broker Smart Office, its officers, directors, employees, representatives, agents and sub-licensees (including without limitation any person or entity that publishes or otherwise distributes the Materials) from and against any claims, damages or liability arising from or related to the use of the Materials (including without limitation any misuse, distortion, blurring or alteration of my Content). I will not make any claim against Collect 200 Pty Ltd T/as Broker Smart Office in respect of or in relation to its use of the Materials;

(j)           I represent that no additional rights or consents are necessary to grant the unrestricted rights to Collect 200 Pty Ltd T/as Broker Smart Office as provided here.
